These General Terms and Conditions of Sale ("GTC") apply to any order placed on the Hugaya store, published by Amadou Sine, sole proprietor, 1 allée Santos Dumont, 94310 Orly, France — SIRET: 992 897 926 00018 — sneamd@gmail.com. Any order implies unreserved acceptance of these GTC.
The products sold are babywearing garments for parents (baby carrier t-shirts). Photos and descriptions are as accurate as possible; slight color variations may exist depending on your screen. The product must be used in accordance with the safety instructions provided (maximum weight, baby's position, supervision).
Prices are indicated in euros, all taxes included. VAT not applicable, article 293 B of the CGI. Delivery costs are specified before order validation. Hugaya reserves the right to modify its prices at any time, the product being invoiced at the rate in force at the time of the order.
The order is validated after payment confirmation, made securely via the methods offered at checkout (credit card, PayPal, etc.). A confirmation email summarizing your order will be sent to you. Hugaya reserves the right to cancel any order that appears abnormal or fraudulent.
Orders are shipped within 24 to 48 business hours, for delivery in metropolitan France within 2 to 4 business days. See our Shipping Policy. In the event of a delay of more than 7 days beyond the announced delivery time, you may cancel the order and be fully refunded.
In accordance with Article L221-18 of the Consumer Code, you have 14 days from receipt to exercise your right of withdrawal, without justification. Hugaya extends this to a 30-day "satisfaction or money back" commercial guarantee, with free returns from France. See our Return and Refund Policy.
All our products benefit from the legal guarantee of conformity (Articles L217-3 et seq. of the Consumer Code, 2 years) and the guarantee against hidden defects (Articles 1641 et seq. of the Civil Code). In case of a defect, contact us at sneamd@gmail.com: repair, replacement, or refund according to legal conditions.
Hugaya cannot be held responsible for damages resulting from product use not in accordance with the safety instructions. Carrying a newborn requires constant supervision by the adult carrier.
In accordance with Article L612-1 of the Consumer Code, in the event of a dispute not resolved amicably, you may resort free of charge to a consumer mediator: [Name and contact details of the mediator to be completed after membership]. You can also use the European online dispute resolution platform: ec.europa.eu/consumers/odr.
These GTC are subject to French law. Any dispute falls under the competent French courts, after seeking an amicable solution.
